China wants to become an innovation-based nation. IP Rights, especially Patents and Utility Models, are of great importance for this goal. However, in order for patent law to fulfill its function, it is important that uniform criteria regarding Protectability and infringement are applied. <\/strong><\/p>\n\n

At present, first-instance judgments in patent disputes and the like can be appealed to the Intermediate People’s Court. The judgment of the Intermediate People’s Court can be appealed to the local Supreme People’s Court. <\/p>\n\n

There are already special courts for patent disputes and the like: Beijing, Shanghai and Guangzhou have a so-called “IP Court”. In addition, most of the Intermediate People’s Courts in other provinces have special IP chambers. <\/p>\n\n

As of January 1, 2019, Intellectual Property disputes involving special technical expertise will be heard by a national-level court, namely the IP Chamber of the Supreme People’s Court, in Appeal Proceedings. Examples of disputes that require special technical expertise are those involving Patents, Utility Models, plant varieties, layout of integrated circuits, technical secrets, computer software, monopolies and the like. The new court jurisdictions therefore apply to these cases. <\/p>\n\n

Disputes concerning Patents, Utility Models and similar technical property rights issues will now be heard by the new IP Chamber of the Supreme People’s Court. Questions regarding patentability and infringement will thus be judged uniformly in the last instance. <\/p>\n\n

The Supreme People’s Court will establish an IP Court and refine and clarify the guidelines for interpreting the laws.<\/p>\n\n

This means that appeals in such cases no longer go to the local Supreme People’s Court, but to the new IP Court of the Supreme People’s Court.<\/p>\n\n

The new jurisdiction applies not only to first-instance civil court judgments, but also to first-instance administrative judgments. In addition to Patents, Utility Models and the like, administrative proceedings in design law matters will therefore also be heard by the new IP Chamber. <\/p>\n\n

Civil disputes concerning Trademarks, Designs and other non-technical IP cases will continue to be handled by the existing local Intermediate and High People’s Courts.<\/p>\n\n
