It is often difficult for outsiders to understand why it takes so long for a patent to be granted. When Patent Attorneys talk about 3 to 7 years, they are met with a lack of understanding. In view of the speed with which products have to be developed and brought to market nowadays, the patent granting procedure seems to be an anachronism. <\/strong><\/p>\n\n

In the second half of the 1990s, a large number of Patents were applied for. Patents were very important for the Internet industry, which was booming at the time, and the number of applications also rose sharply in other technical fields. In response to this, there were increasing calls for more quality in the granting of patents. The patent offices responded with various measures. <\/p>\n\n

The European Patent Office invested a great deal of energy in an early search with a written assessment of patentability. Since 2005, the Application has therefore received the so-called extended European search report. For those who are the first to Filing their invention with the European Patent Office, the search should be sent in good time before the twelve-month priority period expires. According to the recently updated statistics, the extended European search report is now sent within 5.7 months on average. This is exceptionally fast compared to other major offices (USA, Japan, Korea, China, Germany). <\/p>\n\n

In 2014, the European Patent Office launched an initiative to speed up the procedure after publication of the search report. On the one hand, patent files that are already in the Examination Proceedings are to be given a higher processing priority so that the current proceedings can be brought to a conclusion soon. On the other hand, applications with a positive search report are to be admitted for grant within a few months of receipt of the request for examination. <\/p>\n\n

According to the statistics published in October, it still takes an average of 28 months from the request for examination until the Patents are granted. This means that it still takes well over 4 years on average for a patent to be granted. However, this figure also includes those cases in which, for example, 3 or 4 office actions are issued. However, if the Application is granted with only one office action, you will certainly reach your goal much faster. <\/p>\n\n

The duration of Opposition Proceedings is also recorded statistically. The average duration here is 25.8 months, i.e. just over 2 years. <\/p>\n\n

It is certainly good if the patent office endeavors to process applications quickly. However, from the Application’s point of view, speed is not the main yardstick. It is more important that the examiner gains a good understanding of the invention and analyzes the citations precisely. This is the only way for the Application to obtain a patent with an appropriate scope of protection within the desired time. <\/p>\n\n
