The European Community trade mark, which offers uniform trade mark protection in the EU, has been in existence since 1994. In 2009, the legislator commissioned an analysis of the existing system from the Max Planck Institute in order to improve efficiency and legal certainty. Based on comprehensive user surveys, this resulted in Regulation EU 2015\/2424, which came into force on March 23, 2016. What is new? <\/strong><\/p>\n\n

For all those who have appreciated and used the previous Community trade mark system, it can be said that the EU trade mark system remains good! Nothing tried and tested has been abandoned. On the contrary, the legislator has largely limited itself to fine-tuning. For the most part, the existing gaps in the law have been closed in line with ECJ jurisprudence. The only real innovation is the EU certification mark (Art. 74a). This means that there is now an EU-wide certification mark analogous to the long-existing national certification marks. <\/p>\n\n

Here are a few keywords on the most notable changes:<\/p>\n\n

– New name of the office. The cryptic name “Office for Harmonization in the Internal Market” (OHIM) has been replaced by the self-explanatory and promising name “European Union Intellectual Property Office (EUIPO)”. <\/p>\n\n

– New fee structure: While three classes were previously included in the basic fee, each class is now subject to a charge.<\/p>\n\n

– Official searches for similar Trademarks will only be carried out at the request of the Application.<\/p>\n\n

– Trademark protection also covers the unlawful use of the protected sign as a trade name or company name.<\/p>\n\n

– The right-preserving use of the Trademarks in a deviating form is also possible if the deviating form is registered as a separate trademark.<\/p>\n\n

– The start of the opposition period for IR Trademarks is shortened to 3 months, which ultimately reduces the opposition period from 9 to 6 months.<\/p>\n\n

– It is the literal meaning of the designation of goods that is decisive and not the class heading function. Trademarks that are now considered unclear can be clarified until September 24, 2016. <\/p>\n\n

– Non-traditional Trademarks, which could not be registered until now due to a lack of graphic representability, can in future (from September 24, 2017) be registered and thus protected using any suitable and commonly used technology.<\/p>\n\n

– The shape mark can now also consist of a combination of shape and other characteristic features.<\/p>\n\n

– The older designations of origin must be taken into account in the trademark examination.<\/p>\n\n

– Plant variety protection designations are better and more precisely taken into account in the official examination<\/p>\n\n

– The proof period for the use of the older Trademarks runs backwards 5 years from the priority period of the younger Trademarks instead of from its publication.<\/p>\n\n

In addition, there are various amendments that only have the purpose of codifying the current practice established by jurisprudence in the law.<\/p>\n\n

Finally, a number of changes have been made to the governance of the system in order to take better account of future needs.<\/p>\n\n

As a result, we can say that the good previous system has become a nicer and better new one.<\/p>\n\n
